EU Privacy Notice

This EU Privacy Rights Notice supplements Miller Cooper’s Privacy Policy and provides additional information regarding our collection, retention, use, disclosure, and other processing of personal data pursuant to the European Union’s General Data Protection Regulation (“GDPR”). This section applies to “personal data” as defined in the GDPR.

Role as Data Processor

As a licensed CPA firm that provides accounting, tax, and consulting services, Miller Cooper generally acts as a data processor to its clients. In those circumstances, Miller Cooper will process personal data at the direction of its client and the client’s privacy policy and relevant agreement(s) will apply to that processing. This EU Privacy Notice does not apply to the processing of any personal data Miller Cooper conducts as a data processor.

Role as Data Controller

In other limited circumstances, Miller Cooper may act as a data controller. In our role as data controller, Miller Cooper may obtain personal data from multiple sources, including information provided directly to us by individuals through the Website, the Client Portal, during the provision of our Services to you, or from other sources.

We collect the personal data described in the Privacy Policy section “Information We Collect About Your and How We Collect It”.

Personal Data Processing

We may process personal data to for the reasons described in the “How We Use Information We Collect” section of the Privacy Policy.

Miller Cooper does not process personal data for any automated decision-making.

Disclosures of Personal Data

We may share your personal data as described in the “How We Share Personal Information” section of the Privacy Policy.

Legal Basis for Processing

Where applicable, the legal basis for our collection and use of your personal data may include any of the following:

  • Performance of a contract. We process your personal data as necessary to perform our obligations under any contract with you, such as to provide our Website or Services to you or complete transactions.
  • Compliance with a legal obligation. We may need to use your personal data to comply with applicable legal requirements, such as applicable tax or other government regulations or to comply with a court order or binding law enforcement request.
  • Legitimate interests. We have a legitimate interest in using your personal data for our business purposes, including operating and improving our business, Website and Services.

Retention Period

Miller Cooper will store your personal data for no longer than is necessary for the performance of our obligations or to achieve the purposes for which it was collected, or as may be permitted under applicable law. When deciding how long to keep your personal data, we consider whether we are subject to any legal obligations (e.g., any laws that require us to keep records for a certain period of time before we can delete them), whether have taken any legal positions (e.g., issued any legal holds or otherwise agreed to preserve the information), or whether there are other business purposes to retain the information.

In addition to your right to certain information contained in the Privacy Policy and this EU Privacy Notice, you may have the following rights regarding your personal data that we hold:

  • Request access to your personal data.
  • Request correction of your personal data if it is incorrect.
  • Request that we delete or stop processing your personal data under certain circumstances.
  • Object to our processing of your personal information under certain circumstances.
  • Request that we restrict our processing of your personal data, and where our processing is based on your consent, withdraw that consent (which may be done by emailing privacy@millercooper.com) without affecting the lawfulness of processing based on consent before its withdrawal.
  • Request that we transmit your personal data either to you or another service provider under certain circumstances (costs may apply).
  • Be informed of your right to complain to a supervisory authority if you feel that we have not complied with applicable laws regulating your personal data (contact information for supervisory authorities may be found at: https://ec.europa.eu/justice/article-29/structure/data-protection-authorities/index_en.htm).

Please note that the above rights are not absolute, and we may be entitled to refuse requests where exceptions apply. To make a request about your personal data, please contact us using the information located in the “Contact Us” [LINK] section below.

Personal Data Transfers

Personal data may be transferred to Miller Cooper in the United States for processing. Please be aware that the data protection laws and regulations that apply to your personal data in other countries may differ from the laws in the EU. Where required by applicable law, Miller Cooper will use appropriate legal mechanisms and other safeguards to protect your personal data, such as the use of Standard Contractual Clauses.
